On July 19, the California Attorney General’s Office (OAG) issued a press release summarizing its first year of CCAC enforcement. Seventy-five percent of businesses receiving an adjustment notice would have come into compliance within the 30-day timeframe, and 25% are still within that timeframe or are under investigation. The OAG also released summaries of 27 resolved exemplary cases. The OAG has been careful to note that the summaries are not advice and do not include all the facts, but they do offer some leads nonetheless. Unfortunately, the summaries often lack sufficient detail to allow readers to presume the enforcement position taken by the OAG, the exact nature of the alleged violations, or the specific actions taken by the company that satisfied the investigation. of the BVG.

Most of the summaries deal with gaps in notices and inadequate disclosures, including financial incentives (eg, loyalty programs) and inadequacies of consumer rights application programs. However, three of them, which are reproduced verbatim below (emphasis added), inform the application of “do not sell” and digital tracking technologies (eg, cookies). One of those three is directly related to global privacy control signals (a topic the OAG recently insisted on). These cases seem to indicate that the collection by a third-party cookie provider, in the absence of a commitment from the service provider by that provider, may be a “sale” to that provider – a position that the OAG has advanced in enforcement actions that we are aware of – and that this should relate directly to the link and the ‘Do Note Sell’ tool:

A company that operates an online pet adoption platform has required that an authorized consumer agent submit a notarized verification when invoking CCPA rights. The company’s disclosures regarding its data sale were also confusing, and the company did not appear to provide a mechanism for consumers to opt out of the sale of their personal information. The company also urged consumers to take additional steps to unsubscribe directing consumers to a third-party trade association tool designed to manage online advertising. After being informed of the alleged non-compliance, the company removed the notarization requirement for agents, added a link “Do not sell my personal information”, and updated its opt-out web form which allowed consumers to opt out completely from the sale of personal information, including personal information that was exchanged for targeted advertising.

A mass media and entertainment company has not provided consumers with any method to refuse the sale of their personal information by the company. The company’s privacy policy and the right of opt-out notice also did not include the required information on how consumers or their agents could exercise their opt-out rights. The company also did not have a notice when it was collected and did not have a “Do not sell my personal information” link on many of its digital properties. After being informed of the suspected non-compliance, the company has updated its opt-out process, privacy policy and notices to address these issues, and added the “Do not sell my personal information” link to all of its digital properties.

A company that sells electronics maintained third-party online trackers on its retail website who shared data with advertisers about consumers’ online purchases. The company has neither imposed a contractual relationship of service provider on these third parties, nor processed consumer withdrawal requests. that have been submitted through a user-activated global privacy check, for example, a browser extension that reported GPC. After being informed of the suspected non-compliance, the company worked with its privacy provider to complete consumer opt-out requests and avoid sharing personal information with third parties under conditions that amounted to a sale in violation of the CCPA.

[Emphasis added.] The main cookie consent management (CMP) platforms have the ability to link “do not sell” consumer rights requests to the deactivation of certain sets of cookies designated by the publisher and to a code that makes even when the GPC signal is present. In addition, the Internet Advertising Bureau has a CCPA signal framework and program, supported by some CMPs that may convert participating cookies from sales to service provider-only processing. Publishers who have delayed implementing such potential solutions should reconsider the matter in light of these summaries.

Businesses must update their California privacy notices annually, usually starting January 1. We do this by recommending an assessment of current CCPA compliance in light of final regulations, summaries of initial enforcement actions, and other OAG guidance. The oft-touted silver lining of the ongoing COVID-19 pandemic is that it has accelerated large-scale digital transformation. As travel and in-person meetings continue to be limited for health security, digitization has become essential for governments to keep the economy moving and ensure citizens and businesses are well taken care of.

Nationally, the pandemic has shown us that digitization can improve access to key services such as education and healthcare for the general public, while enabling businesses to operate and improve their efficiency and effectiveness. productivity. However, the darker side of increased digitization is that it has also given rise to a new wave of cybercrime focused on employees working from seemingly “secure” locations responding to an onslaught of potentially dangerous links.

Today, more data is moved to the online space than ever before. This makes it more difficult to track cybercrime, as it can arise from anywhere in the world, especially since many organizations – whether government or private sector – do not necessarily have in place. the appropriate security safeguards and protocols. One of the fundamental first steps in solving such a multi-layered and ever-changing problem is to first understand the typical process of how cybercrime occurs.

How the threat arises

Simply put, cybercrime can be divided into two phases: recognition and attack.

The first phase is the Recognition stage, which is usually the longest stage of a cybercrime operation. Here, an opponent will seek to obtain as much information as possible from a target, and as stealthily as possible.

When data is directly accessible, this phase itself may be sufficient to achieve the purpose of data entry, with no further “attacks” required. More likely, the attacker will need to look for technical weaknesses that can be exploited to gain direct access and perform detailed searches of target agency staff to determine who has access to the required data. Skilled Open Source Intelligence Operators (OSINT) can discern this latter point entirely from open source means at no cost to build a staff portfolio to leverage.

The duration of a reconnaissance task is impossible to guess, being entirely dependent on the difficulty of finding the data. An opportunistic cybercriminal looking to implement a quick ransomware attack will spend very little time on such a task – maybe a few minutes – as there is a lot of fruit on hand for them and they care little about nature. of their targets. Conversely, the acquisition of national security secrets (whether in government hands or in the custody of contractors) can warrant months, or even years, of careful data collection. This is also sometimes facilitated by early intrusion and continuous monitoring.

The next phase, Attack, can take many forms, depending on the attacker’s goals. If the technical aspects of recognition reveal the cyber equivalent of a door with a fragile lock, then the operation may be short and simple. This makes the attack akin to a rapid break-in, which can be subtle or overt depending on the adversary’s appetite for risk, attribution and / or long-term access.

For example, in the context of penetration by defense companies, a high level of technical security can be assumed in most cases. Direct technical access is unlikely to provide an adversary with the secrets they seek without some form of subterfuge to facilitate the attack.

In this phase, it is the mapping of human networks that counts. This is mainly done by OSINT before a deception operation. No material is so protected that no one in the parent organization can access it. This even includes offline or “empty” hardware, as the 2010 Stuxnet attack on Iranian nuclear facilities highlighted.

Additionally, staff deception, known as “phishing” or “spear phishing,” in the case of highly targeted and personalized targeting, plays a role in almost all cyber attacks. No technical component may be required in the attack. With a good pretext, an attacker can trick a victim into sending a source document to someone they think is their manager or a colleague.

Organizations are more at risk than ever

The body of open source data available on organizations and their staff will not diminish. Instead, it will only grow exponentially over time, as the tools and know-how to access this data through open source means become more readily available. The increasing prevalence of cyber attacks every year is proof of this.

Whether the targets are government agencies or corporations, the process is the same. It also means that their mitigation possibilities are similar.

First, there must be a extension of defensive surveillance, which means proactively finding vulnerabilities in your own organization, in the open source sphere to help eliminate key data that attackers are looking for. This would use the exact same tools as an attacker and as illustrated in the OSINT National Security Threats, which we released in October 2020. The key is to be the first to find this data.

In addition, no specific technology is required. Indeed, a professional cell could meet the security needs of both their ministry and their business suppliers.

One thing to also keep in mind is that while awareness training helps to encourage the cleaning up of an individual’s personal footprint, it does not affect the data gleaned by the concept of ‘digital shadow’ from posts (direct or indirect) made by friends, family and associates of that individual. A professional defensive watch cell could and should take these steps at this extra level, prioritizing those personnel closest to the target’s intelligence focus, finding the information most likely to be exploited by an attacker. and, at a minimum, informing them of the individual. .

Finally, it should be noted that unpleasant results can indeed occur when the moving a person from an exploitable position is required. This puts them in an alternate role for security reasons.

The need to stay ahead

As our white paper succinctly puts it, “… the national security secrets of tomorrow are the intellectual property of today. This means that assets intended to be protected by many concentric layers of physical security, armed human security and technical security will at some point reside in the more conventionally defended offices of limited liability companies, which has pushed governments and businesses to target more of their employees and the data they own.

While a review of how organizations proactively protect their assets is underway, it is still far from where it needs to be. Like the ongoing pandemic, we are only beginning to understand the long-term effects of the new normal and the global shift in the way we work. This means that the way we use and protect our information is more vital than ever.

I asked, “So how do you find and connect with your target customers? And I expected a variety of different responses depending on the brand or account they were working on.

“We use lookalikes on Facebook,” one replied succinctly, and the others all nodded at the same time.

“Okay, but what else?” I asked, “What happens when we don’t meet our goals and the lookalikes don’t work?” “

Everyone responded in both silence and confusion. It was then that I realized how badly things had turned out.

Marketers don’t really need to understand how data has been used to run successful marketing campaigns. Instead, they relied on the expertise of Big Tech players who provide “free” products in exchange for customer data.

I don’t want to criticize this mindset, but I want to address the funding of the expertise that it invites. Many media experts have been trained on specific tools and technologies, not so much on the fundamentals or why things work the way they do.

We are clearly entering a new chapter in digital marketing. Many users choose not to opt for tracking on iOS devices (up to 94% according to data from Flurry Analytics). What we will see is a return to basics. Companies with a direct link, access and exchange of value with consumers will be able to be successful. In other words, those with first party data will have a major advantage.

I started in marketing in 2003 and have gone through all the changes and developments in different ecosystems. Previously, we had to do extensive research on our target market, conduct interviews, field surveys, and test different media buys with different posts on different locations to find what worked.

But in recent years, we’ve relied on data collected by Big Tech to automate all of this. We could now just broadcast any creation in the world, even targeting a large audience or a large set of keywords, and with all the signals we sent to Big Tech on our own channels – voila – we could. sell products and get results with little understanding of who was actually buying things and why.

It is now considered somewhat new to implement different designs and messages depending on the stage of the consumer’s purchase. With so much automation on display and social media, marketers have been able to be successful without a basic strategy for connecting with their audience.

And think about the hardware and software devices you use. Android phone? Samsung TV? Macbook? Google Chrome? Products that are your gateway to other products and services will become more relevant as consumers become more willing to provide information to use the product. Companies that have a direct connection to the customer will continue to collect relevant data on consumers.

With the exchange of value, we have to go back to some “old-fashioned” methods of conducting opt-in, or what people today call a new buzzword: “zero data”. -party ”. Last weekend I went to several retail stores and each of them asked for my email or phone number at checkout. While I’m sure I could have objected, when they asked if they could subscribe to a 10% off email, I gladly agreed. After all, I could always unsubscribe later, and who doesn’t want to save money at the checkout?

But what I’m talking about is more than an email address capture. The wealth of data that exists on Big Tech platforms is the combination of all the signals, events, and transactions that are occurring as a whole. Marketers need to think more about value exchange and multi-point consumer cohorts and become more aware of the moment in their marketing messages based on accepted data.

Although the name is new, zero-party data is actually a classic strategy, dating back to the 1960s, when consumer information was readily provided for contests, magazines, or other direct mailings.

While many marketers can and should bemoan the loss of accurate tracking, they should also take the opportunity to actually research and understand their customers.

A world without cookies ushers in a new era of digital advertising. Marketers have the ability to build a strategic foundation on a clear understanding of their customers, unique product cycles, and high value-added touchpoints, instead of having this information hidden by Big Tech. In doing so, marketers will create a stronger, more resilient, and more effective foundation to connect with increasingly tech-savvy consumers.

The government of Uttar Pradesh on Sunday released the new population policy for 2021-2030 on World Population Day. In the new population policy, a target has been set to increase the birth rate to 2.1 per thousand by 2026 and to 1.9 by 2030.

The state’s total fertility rate is currently 2.7 percent.

When the policy was unveiled at the inauguration, UP Chief Minister Yogi Adityanath said there should be a gap between two children in order to control the state’s population.

The unveiling of the policy comes days after a draft population control bill was posted on the state’s law commission website.

He added that a growing population was an “obstacle to development” and that more efforts were needed to control it.

“Around the world, from time to time, concerns have been expressed that increasing population may be an obstacle to development, and for four decades discussions about this have been underway. Population growth is also linked to poverty. Every community has been taken. in population policy 2021-2030, ”said Adityanath.

“Countries and states that have made efforts in this direction have seen positive results. However, further efforts are needed in this regard,” he said, adding that the UP government was implementing this policy, keeping in mind all strata of society.

Draft new demographic policy

A population control bill was released in the public domain on Saturday. Through the proposed policy, efforts will be made to increase the accessibility of contraceptive measures published under the family planning program and to provide an appropriate system for safe abortion.

He also promotes a two-child policy, the violation of which would mean that people would be barred from running for office in local bodies, applying for government jobs or receiving a government grant.

Comprehensive arrangements will be made for the care of the elderly, in addition to better management of education, health and nutrition for adolescents aged 11 to 19.

“Health clubs” in schools will be formed in addition to instructions which will also be given to arrange for digital monitoring of newborns, adolescents and the elderly.
